Dialing Service Terms

The following policies apply to the Dialing Service (“Terms”):
The Dialing Service is not a telecommunications service and we provide it on a best efforts basis. Important distinctions exist between telecommunications service and the Dialing Service offering that we provide. The Dialing Service is subject to different regulatory treatment than telecommunications services. This treatment may limit or otherwise affect your rights of redress before regulatory agencies.
Non-Availability of Traditional 911 or E911 Dialing Service
The Dialing Service does not support traditional 911 or E911 access to emergency services. You acknowledge and agree that the Dialing Services provided by TigerLRM has limitations relative to emergency services that are available on most traditional telephones services. We do not offer 911 Dialing.
You shall inform any employees, household residents, guests and other third persons who may be present at the physical location where you utilize the Dialing Service of (i) the non-availability of traditional 911 or E911.
You Need to Make Alternate 911 Arrangements
If you are not comfortable with the limitations of the 911 Dialing service, you should consider having an alternate means of accessing traditional 911 or E911 services.
No 0+ or Operator Assisted or x11 Calling
The Dialing Service does not support either (a) 0+ or operator assisted calling (including, without limitation, collect calls, third party billing calls or calling card calls), or (b) 311, 511 and/or other x11 services.
Incompatibility with Other Services
The Dialing Service is strictly provided as a means of facilitating voice calls to customer leads via an action initiated on the TigerLRM Service that triggers a call from your existing telephone service. As such, the Dialing Service is meant as an enhancement to, and not a replacement of, your existing telephone communication service. The Dialing Service is not meant to comply with any other communication services, including, but not limited to, the following:
Security Systems. The Dialing Service is not compatible with security systems. You are required to maintain a telephone connection through your local exchange carrier in order to use any alarm monitoring functions for any security system installed in your home or business.
Certain Broadband and Cable Modem Services. You acknowledge that the Dialing Service may not be compatible with some broadband services. You further acknowledge that some providers of broadband service may provide modems that prevent the transmission of communications using the Dialing Service. We do not warrant that the Dialing Services will be compatible with all broadband services and expressly disclaim any express or implied warranties regarding the compatibility of the Dialing Service with any particular broadband service.
Use of Service and Device by Customers Outside of the United States. Although you may use the Dialing Service to place calls to foreign countries from within the United States, we do not presently offer or support the Dialing Service in any countries other than the United States. If you use the Dialing Service from any location outside of the United States, you will be solely responsible for compliance with all applicable laws and any violations of local laws and regulations resulting from such use.
Theft of Service. You shall notify us immediately, in writing or by calling our customer support line, if at any time you become aware or reasonably suspect that the Dialing Service is being stolen, fraudulently used or otherwise being used in an unauthorized manner. When you call or write, you must provide your account number and a detailed description of the circumstances of the theft, fraudulent use or unauthorized use. Failure to do so in a timely manner may result in the termination of the Dialing Service and additional charges to you. Until such time as we receive notice of the theft, fraudulent use or unauthorized use, you will be liable for any and all stolen, fraudulent or unauthorized use of the Dialing Service.
The Dialing Services may provide a function that allows you to record individual telephone conversations. The laws regarding the notice, notiﬁcation, and consent requirements for recording conversations vary from state to state. In some states, you are required to obtain consent from all parties to a record a conversation. You are solely responsible for complying with all federal, state, and local laws in any relevant jurisdiction when using this feature. TigerLRM expressly disclaims all liability with respect to your recording of telephone conversations. You hereby agree to fully, ﬁnally, and forever release, discharge, hold harmless, and fully indemnify TigerLRM from and against any damages or liabilities of any kind related to your (or any User’s) recording of any telephone conversations using the Dialing Services. For TigerLRM’s quality control purposes or any consulting services for which TigerLRM is engaged, you agree that TigerLRM may, in its sole discretion, record any call between TigerLRM and you, including any of your Users. You also authorize us to review any lawfully obtained recordings solely to the extent necessary to perform any services for which you have engaged TigerLRM.
Use of the Dialing Service
The Dialing Service may only be used for your internal business purposes in order to contact and transact business with potential and actual customers of your business. The Dialing Service may not be used for or on behalf of any other party.
Carrier Fees and Account Restrictions
Accounts in violation of TigerLRM or carrier rules and regulations may be subject to suspension of the Dialing Service, or termination of the Dialing Service in addition to fines and other penalties passed through TigerLRM by the carriers.
It is your responsibility to be aware of any additional restrictions when using the Dialing Service, and to adhere to any and all policies related to the recipient number.
No Unlawful Use. You shall (and shall require your Users to) only use the Dialing Service solely for your own lawful internal business purposes and in strict compliance with all Applicable Laws. TigerLRM reserves the right to immediately terminate the Dialing Service if, in our sole and absolute discretion, we determine that you or any of your Users have used the Dialing Service for an unlawful purpose. In the event of such termination, then in addition to all other rights and remedies available to us, you will be responsible for the full charges to the end of the then-current term, as applicable, including, without limitation, unbilled charges, plus a termination fee, if applicable, all of which will become immediately due and payable upon termination of the Dialing Service. If we believe that you have used the Dialing Service for an unlawful purpose, we may forward the relevant communication and other information, including your identity, to the appropriate authorities for further investigation. You hereby consent to our forwarding of any such communications and information to these authorities. In addition and without limiting the foregoing, TigerLRM will provide information in response to law enforcement requests, subpoenas, court orders, to protect its rights and property and in the case where failure to disclose the information may lead to imminent harm to the customer or others.
Inappropriate Conduct. Neither you nor any of your Users shall use the Dialing Service in any way that is threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, or any similar behavior. TigerLRM reserves the right to immediately terminate the Dialing Service if, in our sole and absolute discretion, we determine that you or any of your Users have used the Dialing Service in any of the aforementioned ways. In the event of such termination, in addition to all other rights and remedies available to us, you will be responsible for all charges to the end of the then-current term, including, without limitation, unbilled charges, plus a termination fee, if applicable, all of which will become immediately due and payable upon termination of the Dialing Service. If we believe that you have used the Dialing Service in any of the aforementioned ways, we may forward the relevant communication and other information, including your identity, to the appropriate authorities for investigation and prosecution. You hereby consent to our forwarding of any such communications and information to these authorities. In addition, and without limiting the foregoing, TigerLRM will provide information in response to law enforcement requests, subpoenas, court orders, to protect its rights and property and in the case where failure to disclose the information may lead to imminent harm to the customer or others.
